Article 30 of the Constitution of Poland as the foundation of the system of life and human dignity protection


Abstrakt:

Article 30 of the Constitution of the Republic of Poland, while invoking the „innate and inalienable” human dignity, indicates the constitutional foundation of human life protection. Apart from art. 30, the notion of human dignity appears in the preamble to the Constitution, which summons all those who use the basic law to do so while taking care of preserving „the innate human dignity”. At the foundation of the structure of the system of the protection of an individual’s rights and liberties there is an inalienable foundation in the form of human dignity, which is overbuilt with a complex structure of rights and liberties which serve the human individual and which can be restricted only within the framework of the proportionality principle (art. 31 of the Constitution). The present article is an attempt to show the cultured sources and legal consequences of the notion of „human dignity”.
